The costs of arbitration are a real strategic and financial issue for companies. Indeed, in a hesitant economic context, companies request maximum predictability of the risks they may have to face and have recourse, in the meantime to new financing methods which admissibility and allocation remains uncertain.
In this article, Caroline Duclercq identifies these “new” costs and assesses the bases of their eligibility and allocation.
